Does that mean that it is not possible to libel the dead, so once someone is dead you can write whatever you like about them? Or does it mean that you are not allowed to write anything that could be considered libellous about someone who is dead?midget wrote:And you can not libel the dead.

If it's true it's not libel.

But it can be challenged as defamation, living or dead.

Even changing names is not certain protection - it's about resemblance.
Re: Hertford Memories - The Book
So you can't even have SWSNBN all through the book instead of her name?chaosriddenyears wrote:Even changing names is not certain protection - it's about resemblance.

Re: Hertford Memories - The Book
Not sure but I think there's a certain amount of risk involved. Haven't there been cases of people being portrayed in books under false names (or even perhaps no name at all) and it being so obvious who it is that it has been taken to court?
Would have to ask legal advice on this one though!
Of course if you write that SWSNBN was a beautiful and inspiring person I don't suppose anyone could call this libel......
Fiction perhaps, from all I've read on this forum!

I must be really boring then, because I would always ask permission first

One thing that really has stuck in my mind is Maggie's version of a verse of the Foundation Hymn. It should live on! I would certainly ask her permission...
Perhaps The Book should be put on hold for, say, a decade? But, as I said on Facebook, there are loads of genuinely funny and crazy reminiscences that wouldn't offend anyone!

More than enough I should think - and I don't think that descriptions of members of staff in all their eccentricity is very likely to unleash a libel case. I would just do it and have fun with it.

What about Mrs Dean, Lynn?
You wrote so well - so vividly - I felt I was there with you!
